If you were drinking and walking home, cop is parked across the street from bar. do you have to have ard?

No priors. Said you were drinking. Live 5 minutes from bar. Person with you said not guilty even though person was the reason picked up. This person got a fine. Other person got fine (4 times the amount) , said have to go to ARD to clear record or be on probation. Big fine goes to guy ( who didn't want to go to bar to begin with) other with small fine( cute girl , alcoholic). cop took her to her house. Guy went to police station.

If the person got ARD, then they weren't walking; as ARD is a one-time alternative to a trial, conviction, and possible mandatory jail sentence for the offense of Driving Under the Influence of Alcohol or Controlled Substance.

So, there is something missing from their story.
